Who is eligible for criminal record expungement?
- Most individuals who have infractions with or without probation may be eligible
- Anyone who was convicted for a misdemeanor or felony, but was not placed under the Department of Corrections and Rehabilitation or sentenced to time in prison, may petition for dismissal in the state of Illinois
Essentially, this includes only those who were given time in county jail, fines, probation, or any combination of these penalties. In addition, the individual must not be serving any other sentences, be charged with anything else or on probation. DUI’s may not typically be expunged in Illinois. All of their previous fines and probationary periods must be complete.
What happens after you petition for a dismissal?
Once you petition for dismissal, the court will look over your request and can take your verdict of guilt, no contest plea, or guilty plea and in input a not guilty plea. Once this has been decided upon, they can dismiss the conviction, showing on your record that there is a dismissal rather than a conviction. Not all convictions are eligible to be expunged, but it is best if you speak with a lawyer about the specifics of your case.
